FOIA Fee Schedule
Fees for search, retrieval or redaction of records will not exceed the prorated hourly salary of the lowest paid employee who, in the reasonable discretion of the Department, has the necessary skill and training to perform the request. The prorated hourly salary will be calculated by dividing the employee’s salary by the number of hours worked annually, 2,080 hours, and then multiplying that number by the number of hours it took the employee to search for, retrieve and redact that records. The hourly fee is $21.
Fees for copies, if the documents cannot be produced electronically, will not exceed the prevailing commercial rate for producing copies. Presently, the cost is $0.15 for black and white copies, and $0.25 for color copies.
Fees for postage, shipping and packaging will be assessed at their actual cost, if records cannot be provided electronically.
Fees will not be charged for examination and review of documents to determine if they are subject to disclosure.
Fees may not be charged or may be charged at a reduced rate where the Department, in its discretion, determines that a waiver or a reduction of the fee is in the public interest because furnishing the information can be considered as primarily benefiting the general public.
A deposit not to exceed twenty-five percent of the total reasonably anticipated cost for reproduction of the records may be assessed prior to the Department searching for or making copies of records. The balance must be paid at the time the records are picked up or prior to their being mailed.
Payments may be mailed to:
