Licensing Information

Modular Building Manufacturer:

To become a modular building manufacturer you must complete the Modular Building Manufacturer License Application and submit it with the required fee and surety bond to the SC Modular Building Program. A modular building manufacturer must have a third party inspection agency and a modular building manufacturer's representative at all times. A “manufacturer’s representative” means any person employed by a modular building manufacturer who sells, or offers for sale, modular buildings or components.

To find a South Carolina licensed third party inspection agency you may use the Licensee Lookup tool and search under the Building Codes Council using the BCT license classification.

Manufacturer’s Representative:

The manufacturer's representative may be "any person employed by a modular building manufacturer who sells, or offers for sale, modular buildings or components," per state regulation Chapter 8, Article 8-602 (18). It is encouraged that the manufacturer and representative familiarize themselves with the Statutes & Regulations governing the practice of modular building manufacturing.

To become a licensed manufacturer’s representative you must complete the Modular Building Manufacturer’s Representative License Application and submit it with the required fee and surety bond to the SC Modular Building Program. Please see the application for fee and bond requirements.

Third Party Inspection Agency:

An approved inspection agency means an agency approved by the Council to provide plan review and approval, evaluation, and inspection in addition to adequate follow-up services at the point of manufacture to insure that production units are in full compliance with the provisions of the Modular Building Construction Act. An approved inspection agency must retain a building construction-oriented registered professional engineer or architect who must be responsible for compliance with the Modular Building Construction Act and regulations of the Council.

Additional Requirements

At the end of each month, the Modular Building Manufacturer must submit a Label Disposition Report. Reports may be emailed to the Council at maggie.smith@llr.sc.gov, or sent by fax to 803-896-4814.

At their March 24, 2021 meeting the SC Building Codes Council voted that, per Regulation 8-623, surety bonds are the only allowable form of security meeting the requirement of the Regulation for modular manufacturers and manufacturer’s representatives. This decision will take effect on 6/30/2021. Original bonds should be on the Council-approved form and be submitted to the SC Building Codes Council with the principal's signature and a visible surety company seal on the bond form, and should be accompanied by a copy of the surety's Power of Attorney. Surety bond continuations should be submitted to the Council by email, fax, or mail once received by the surety company. Please contact the Council with questions.
